General Skilled Migration Visas

Candidates who have one or more skills listed in the Skilled Occupation List for Australia migration may apply under any of the subclasses under this visa category.

There are certain eligibility criteria that can be applied to all the General Skilled Migration visas. These include:

  • Age less than 45 years at the time of application
  • Education qualification equal to Australian bachelor’s degree, diploma or trade qualification
  • Nominate an occupation from an approved Skilled Occupation List(Either MLTSSL or STSOL)
  • Skills assessment done by an assessing authority, relevant for your occupation, before applying for a visa.
  • Earn required scores in a recognized language proficiency test- IELTS, OET, Pearson (Academic), or Cambridge (CAE) To prove your proficiency in English

General Skilled Migration Visa categories

The General Skilled Migration program of Australia has several subclasses, which are broadly divided into two categories–permanent and provisional. A candidate can apply for these visas either onshore or offshore.

Skilled visas

With skilled visas, you can live and work in Australia as a permanent resident. To be eligible for these visas, a candidate must have:

  • A relevant occupation
  • Skills assessment done for the occupation by a relevant assessing authority
  • Report on the English language test
  • Earn a minimum of 65 points

Besides, the occupation nominated by the candidate must be included in the Medium and Long-term Strategic Skills List(MLTSSL).

Skilled- Nominated (Subclass 190)

Skilled workers nominated by an Australian state or territory can apply for this visa with which, the holder can live and work in Australia as a permanent resident. To be eligible for this visa, a candidate must have:

  • A relevant occupation
  • Skills assessment for the occupation done by the concerned assessing authority
  • Results of the English Language Test to prove language proficiency
  • A minimum score of at least 6.0 points in each of the four abilities(Speaking, Reading, Writing and Listening) in IELTS. The candidate must have appeared for the test within three years before submitting the application.
  • Nomination from a state/territory government agency, which adds five points to the candidate’s total score.
  • A minimum score of 65 points
  • The candidate must reside in the state or territory which nominates them for at least two years
  • Invitation from the minister to apply for the visa

Skilled Regional (Provisional) visa (subclass 489)

Skilled workers with a nomination from a state/territory to live in a regional or low population growth area or an eligible relative residing in a designated area who is willing to sponsor them can apply for permanent residence in Australia through this visa category. To be eligible, the candidate must have:

  • A relevant occupation
  • Skills assessment for occupation done by a relevant assessing authority
  • Results of a recognized English test score
  • Nomination from a state/territory government agency or sponsorship by an eligible relative
  • Minimum 65 points in the points test.

The subclass 489 visa has two pathways:

The Extended stay pathway, which is for those who currently hold any of subclass 475, 487, 495 or 496 provisional visas.

The invited pathway is for candidates who do not meet the criteria for an extended pathway. The candidate must either be nominated by an Australian state or territory government agency or sponsored by an eligible relative residing in a designated area in Australia.

The subsequent entry pathway is for family members of those who hold a Skilled Regional visa 489 or Subclass 495,475, 487or 496 visas.

The maximum validity of this visa is four years and the visa holder has to reside and work in a specified regional area of Australia in order to become eligible to apply for a permanent visa. This would be a regional or low-population growth metropolitan area if the candidate is nominated by a state or territory government agency. At the same time, if the candidate has a relative’s sponsorship, it would be a designated area of Australia. In order to be eligible to sponsor a candidate, the relative must be residing in one of the designated areas of Australia, which are:

  • South Australia
  • Northern Territory
  • Victoria
  • Tasmania
  • Western Australia
  • Queensland (everywhere except Brisbane)
  • New South Wales (everywhere except Sydney, Newcastle and Wollongong)

The holder of this visa may apply for the permanent Skilled Regional visa (subclass 887) later, with which, they may live and work in Australia as a permanent resident. With a nomination or sponsorship, the candidate becomes eligible for an additional 10 points in the points test.

Skilled Regional (Subclass 887)

This permanent visa does not have any points-based requirements. To be eligible to apply for this visa, a candidate must:

  • Hold a subclass 489, 495, 496, 475 or 487 visas or a Bridging visa A (BVA) or B after applying for a subclass 489, 495 or 487 visas.
  • Have lived in a specified regional area of Australia for at least two years or have worked full-time in a specified regional area of Australia for at least one year.

Work visa

Temporary Skill Shortage (TSS) (482)

The Temporary Skill Shortage (TSS) (482) visa allows Australian businesses to fill short-term skill gaps with foreign workers. To get this visa, the employer must be willing to sponsor the candidate. The TSS visa has two streams:

Short-Term Skilled Occupations List (STSOL): The visa issued under this stream has a two-year validity and an option to reapply for another two years. But this stream does not offer a permanent residence pathway.

Medium-Term Skilled Occupations List (MLTSSL): This four-year visa can be renewed as long as the occupation is on the list. After three years, the candidate may also apply for permanent residence. To be eligible, the candidate must be sponsored by their current Australian employer, who must nominate them for a specific job. The candidate must also demonstrate an adequate level of English language proficiency–IELTS 5 or 6 depending on the TSS stream.

Business and Investment Visas:

Australian business visas allow international businesspersons to set up a new business or purchase and manage an existing business in Australia. The types of Australian business visas currently available are:

  • Business Innovation and Investment (Provisional) visa (subclass 188)
  • Business Talent (Permanent) visa (subclass 132)

In order to obtain any of these visas, the candidate must be nominated by a state or territory or Australian agency. Further, the candidate must be invited by the Minister of Immigration and Border Protection to apply for the visa.

Business Innovation and Investment (Provisional) visa (subclass 188)

The four streams under this visa are:

Business Innovation Stream: Business people who wish to set up, develop and manage a new or existing business in Australia can apply for Australia business visa through this Stream. In order to apply for this visa, the candidate must be nominated by a state or territory government.

Investor Stream: Those willing to make an investment of at least AUD 1.5 million in an Australia state or territory and maintain a business or investment activity in the country can apply for a visa through this stream. To be eligible, the candidate must be nominated by a state or territory government.

Significant Investor Stream: Those willing to invest at least AUD 5 million into complying significant investments in Australia and maintain a business or investment activity in the country can apply for a visa under this stream. The applicant must be nominated by a state or territory government or Austrade.

Premium Investor Stream: Those ready to invest at least AUD 15 million into complying premium investments in Australia and maintain a business/investment activity in the country can apply for a visa through this Stream. The applicant must be nominated by Austrade on behalf of the Australia government.

This is a provisional visa with which one can acquire eligibility to apply for Business Innovation and Investment (Permanent) visa (Subclass 888).

Business Talent (Permanent) visa (subclass 132)

This permanent visa allows the holder to set up a new business or develop an existing business in Australia. The visa has two streams:

  • Significant Business History Stream
  • Venture Capital Entrepreneur Stream

To be eligible, the candidate must be nominated by a state or territory government agency and receive an invitation from the Minister to apply. The candidate must have either:

  • Net business and personal assets worth minimum AUD 1.5 million and annual business turnover of at least AUD 3 million, if the candidate is planning to apply for a visa through the Significant Business History Stream.
  • Obtained at least AUD 1 million in venture capital funding to start the commercialization and development of a business idea in Australia, if the candidate is applying through the Venture Capital Entrepreneur Stream.

Australia student visa
 

A student enrolling for a study program in Australia with a minimum duration of four months must have an Australia student visa. Australian student visa does not have an age restriction. But in order to apply for the visa, the candidate must have an unconditional offer of place from an Australian university and the student must have accepted that place in writing and paid the tuition fee deposit.

For all study programs, the student must apply for a Subclass 500 visa. One can apply for the same after receiving a Confirmation of Enrolment(CoE) from the chosen University. You can apply for a student visa even if you already have had a working holiday visa in Australia.

Cost of Australia student visa

The application fee for Australia student visa is currently AU$575 which has to be paid while submitting the application. Australia renews application charges every year on July 1. If you have dependents who would be accompanying you to Australia, you will have to pay additional fees.

The validity of Australia student visa

The Australia student visa will be valid until the end of your study program. The visa may also allow the holder to spend some more time in Australia even after the completion of the studies. This may range from one month to three months. For example, if the duration of your course is ten months and ends in November or December, the validity of the student visa would usually end on March 15 of the following year.

Visa processing time

The processing time of Australia student visa is usually four weeks. However, it is advisable to apply for a visa as soon as one receives the CoE.

Travelling to Australia

With a student visa, you may arrive in Australia up to 90 days before the commencement of the course.
 

Working on a student visa

A student can work up to a maximum of 40 hours a fortnight during the semesters and full-time during holidays. However, one cannot start working until the course begins. Work that has to be done by the student as part of the course is not included in the limit. The candidate must have ‘permission to work’ even if what they are doing is unpaid or voluntary work and such work would be included in the 40-hour limit.

Taking partner along

The spouse or partner of a student visa holder can accompany them to Australia. However, they will have to prove that their relationship is genuine and exclusive. In other words, they must have been living together for at least 12 months.

Health check

At present, the UK or Ireland citizens do not require a health assessment except in certain circumstances. For example, if a person is going to Australia to train as a doctor, dentist or nurse or if the person would be working in an Australian childcare center, a health assessment is a must. If you have spent more than three consecutive months in another country in the last five years, then also you would need health assessment.

Is it possible to apply for another visa at the end of the course?

In certain circumstances, the candidate is allowed to apply for a further visa at the end of the course. The students who have completed a program with a duration of at least two years can apply for a Post Study Work Visa, which allows them to continue to stay in Australia and work for two to four years.

Obligations of an Australia student visa holder

  • Remain enrolled in a course registered on CRICOS (cricos.deewr.gov.au).
  • Maintain satisfactory attendance on the course, as required by the education provider.
  • Make satisfactory academic progress for each study period.
  • Advise your education provider of your home address within seven days of arriving in Australia. You must also inform the education provider if you change this address during the course of your studies within seven days.
  • You must maintain suitable health insurance throughout your time in Australia. This can be done by obtaining OSHC.
