Do you need an Authorization to Return (ARC)?

Removal Orders viz. Departure Order, Exclusion Order, or Deportation Order may require the immigrant to submit ARC if he or she wants to re-enter Canada. The immigration authorities have set rules and regulations regarding the issuance of ARC and the eligibility of individuals for the same. The reason quoted for removal and the type of removal will determine whether an ARC is required or not.

The Removal Order received from the Immigration Refugee and Citizenship Canada (IRCC) or the Canada Border Services Agency (CBSA) can be checked to determine the type of removal. The number mentioned on the order will state the type of Removal order. Confirming the requirement of ARC as well as the procedure, would depend on which Removal Order was issued.

Departure Order: 

Those who received Departure Orders are supposed to leave Canada within 30 days. Subsequent actions will be initiated if the individual fails to abide by the order to leave the country. If the person leaves Canada after thirty (30) days or fails to verify exit with the immigration official at the port of exit, the Departure Order will become Deportation Order automatically. The ex-pat will not require an ARC if he or she has pursued the following stipulations and hence can enter Canada subject to the normal immigration procedure:

  • Left the country within the 30-day timeframe given by the authority
  • The person has verified the departure at the Canadian immigration services at the port while exiting

Exclusion Order: 

The expatriates who left Canada on Exclusion Order need not obtain an ARC if they have observed the below conditions. 

  • The individual wants to re-enter Canada after 12 months from the date of leaving Canada
  • The individual holds a valid Certificate of Departure IMM 0056B. The certificate will indicate the exact date he or she left Canada

In this case, only the normal immigration examination would be undertaken at the port of entry. On the other hand, an ARC is mandatory if the individual wants to return to Canada within twelve (12) months from the date of leaving the country or does not possess a Certificate of Departure.

Deportation Order: 

An ARC is a mandatory requirement if the ex-pat was removed from Canada on a Deportation Order. No conditions apply when an individual has to be deported, citing conditions that are inadmissible to Canada.

Expatriates removed from Canada due to their involvement in criminal activities cannot get Authorization to Return to Canada (ARC) directly. The person should apply for Criminal Rehabilitation first, and a Temporary Resident Permit has to be obtained to enter Canada. Hence, criminally inadmissible persons will have to pursue additional procedures to get other requisite documents.
