Canada offers numerous pathways for foreign nationals to make the country their home, ranging from work visas and family sponsorships to the provincial nominee and express entry programs.
However, the complexity of immigration law is often underestimated by those who attempt to navigate the process independently, as emphasized by Ravi Jain, a certified specialist in immigration law and managing senior lawyer at Green and Spiegel LLP in Toronto.

Ravi Jain emphasizes the common misconception that individuals can save money by self-filing, only to discover later that incorrect submissions or missing documentation can lead to delays, ultimately costing applicants valuable time and, in some cases, additional expenses. An immigration lawyer ensures the meticulous preparation of a case and can expedite the process by minimizing unnecessary back-and-forth interactions.

Moreover, immigration law undergoes frequent and sometimes intricate changes. What may initially appear as a straightforward situation could, in reality, involve intricate details. An immigration lawyer possesses the expertise to pose pertinent questions and offer comprehensive counsel on the full spectrum of available options.

In his article 'Choosing your Immigration Lawyer: Some Criteria to Consider,' Québec immigration lawyer Hughes Langlais cautions, "Do not hire the first lawyer you find." He adds, "Given the diverse nature of this legal field, practitioners may exhibit varying levels of competence in specific areas, such as refugee claims, work permits, family reunification, or representation in Federal Court."

Langlais further emphasizes that after identifying a lawyer's expertise in the relevant practice area, the next consideration should be their reputation. He advises individuals to verify the lawyer's standing with the provincial law society and review online feedback and comments. Furthermore, holding a teaching position or a role within the Law Society can indicate a lawyer's credibility.".

As Ravi Jain says, "It's valuable to consider whether the lawyer has dedicated their time to volunteering with lawyers' associations and conferences frequently seek them out as an expert speaker." He emphasizes the importance of mentorship, posing the question, "Has the lawyer collaborated with other respected immigration lawyers in an environment where knowledge has been shared over many years?" Due to the highly specialized nature of the legal field, Jain suggests opting for a lawyer who focuses solely on immigration law.

Jain recommends that prospective newcomers should avoid lawyers who offer guaranteed success. Unlike death and taxes, immigration law provides no certainties, especially regarding work permits, permanent residency, or refugee status.

He stated that lawyers of integrity would never promise to issue a visa or permit because, ultimately, it is not the lawyer but immigration officials who have the authority. These officials can even make mistakes on some occasions.

According to certified immigration specialist Sergio Karas, lawyers should provide clients with practical guidance and refrain from raising unrealistic expectations regarding the chances of success or the duration of the process. He highlights that this approach distinguishes lawyers from those he refers to as "unscrupulous individuals" who make guarantees of success in their advertising.

Once hired, immigration lawyers should actively ensure clients gather necessary documents and warn them about possible delays, Karas advises.

"Clients should recognize that quick solutions may not always be available, but they can pave the way for future success." He further adds that "For instance, a client might not initially meet residency requirements but could secure a temporary work permit to gain Canadian experience or consider studying in Canada as a pathway to eventual residency."

"Lawyers must challenge clients when they're not forthcoming. Good relations with authorities matter because new clients will come, and nobody's perfect," notes Karas.

As per Karas, immigration lawyers must keep updated about new developments since the laws and programs are subject to change due to political influences. Additionally, he suggests that they should avoid isolating themselves within their practice area and instead expand their knowledge into other fields, as this will contribute to becoming better lawyers, as per Karas.

He also recommends building an international network. "Establish connections with lawyers in other countries for knowledge exchange, diverse perspectives, potential referrals, and collaborative opportunities, providing valuable insights into international practices," he suggests.

Jain notes that clients often worry about fees, but they should be cautious when encountering services offered at low prices.

Experienced lawyers at reputable firms may come at a slightly higher cost. Regrettably, the field of immigration law includes unqualified consultants. While some may offer lower fees, their services may not match a lawyer's. Conversely, there are unscrupulous individuals within specific communities who exploit their own by charging exorbitant fees well above what lawyers would demand," warns Jain.
